- General
- These terms and conditions (“the Conditions”) form part of the agreement (“the Agreement”) between Infinite Scotland and you. Infinite Scotland is the trading name of Infinite Scotland Ltd, a limited company incorporated in Scotland (SC620309) whose registered office is at 33/6 Montague Street, Edinburgh, EH8 9QS, Scotland and is referred to in these Conditions as ‘we’, ‘us’ or ‘our’. Before booking with us you should read the Conditions carefully.
- If any of these Conditions are invalid or unenforceable the remainder will not be affected and will remain valid and enforceable.
- The Agreement shall be governed in accordance with Scottish Law and you hereby agree to submit to the exclusive jurisdiction of the Scottish Courts in relation to any dispute or other matter arising therefrom.
- You must ensure that the full names and personal information given to us at the time of booking are accurate in all respects and match the information shown on your passport.
- Any notification to be given in writing under the Conditions should be given by letter or email.
- Our tours
- We offer bespoke private tours for small groups of families and friends and solo travellers, tailor-made especially for you.
- The price quoted to you at the time of booking will be based upon the exact tour agreed with you.
- We are under no obligation to give you a breakdown of the total price into its constituent parts. However, the price will include:
- Full itinerary planning, with you and for you;
- A walking-guide or driver-guide and vehicle for the duration of your trip, including overnight accommodation for your guide where required. Note that the duration of each day’s touring and activities is not expected to exceed nine (9) hours. Where your guide is asked, and agrees, to provide services to you in excess of nine (9) hours, an additional charge may be made;
- Special “experiential” visits or tours, planned directly by us with the supplier on your behalf;
- Fuel, tariffs, insurance (public liability and vehicle).
- The price does not include:
- Accommodation – though we can give you suggestions for each destination;
- Your own food, drink or other ancillary personal expenditure;
- Travel to the agreed starting point, and away from the agreed end point;
- Travel insurance (your own);
- General admission fees to sites of interest – we keep these out of the price in case you change your mind at any point during the trip and just want to put your feet up;
- Gratuities.
- Booking & Payment
- Once we have agreed upon your itinerary, a deposit of 25% of the total quoted price is required in order to confirm your tour.
- The balance of the total price must be paid eight (8) weeks prior to the start of the tour.
- Bookings made less than eight (8) weeks prior to the start of the tour must be paid in full in order to confirm the tour.
- Any payment made by you will constitute your acceptance of this Agreement.
- Payment may be made by secure international Electronic Bank Transfer in Pounds Sterling (GBP). Details will be provided at the time of booking.
- The payment received by us should be equivalent to the total price of the tour, without any deductions for any bank or transfer charges or fluctuations in the foreign exchange rate at the time of booking.
- If we arrange or provide any further services during the course of the tour, as agreed with you in writing and in addition to the agreed itinerary and inclusions, payment must be made at the time of provision of such additional services. Such additional payments may be made either by Electronic Bank Transfer or in cash to your guide. A receipt will be provided for any additional payment made.
- Changes or Cancellation by you
- Once your deposit is paid it is not refundable. It is therefore important that you have your own travel insurance to protect you from losing money in the event that you need to cancel the tour.
- Cancellation not less than 4 weeks before the tour is fully refundable, less the deposit and an administration fee.
- Cancellation within 4 weeks of the tour is not refundable but it is within our discretion to apply some or all of the monies paid by the customer to a future tour.
- We will make every effort to re sell the tour dates. If we are successful then a full refund, less the deposit and administration fee, will be paid.
- Note that on some tours our cancellation policy may vary to reflect any non-refundable payments made by us to our suppliers in order to confirm certain items within your agreed tour itinerary. Where this is the case we will notify you in advance that such non-refundable payments are required.
- If you wish to make any changes to your tour itinerary after it has been confirmed this may result in a change to the total price, depending on the changes made.
- Where there is an increase in the total price within eight (8) weeks of the start of the tour, payment of the additional amount will be due immediately in order to confirm the changes made.
- Where there is a reduction in the total price not less than four (4) weeks before the start of the tour, the amount of the reduction will be refunded to you, less an administration fee, and such that the total monies received by us from you is no less than the initial 25% non-refundable deposit paid.
- Where there is a reduction in the total price within four (4) weeks before the start of the tour, such an amount is not refundable, but it is within our discretion to apply this amount to a future tour or additional service to you.
- Changes or Cancellation by us
- In the unlikely event that we have to cancel a trip due to unforeseen circumstances, please be assured that we will give as much notice as possible. All monies paid, including your deposit, will be refunded in full if we cannot agree to reschedule the tour.
- It is unlikely we will have to make any changes to your tour and any changes are usually very minor.
- If a major change becomes necessary, we will inform you as soon as reasonably possible if there is time before your tour begins. When a major change or cancellation occurs you will have the choice of either accepting the change of arrangements, purchasing another tour from us or cancelling your tour. We will refund all payments made directly to us in respect of the cost of the tour. We will not refund any personal expenses you may have incurred as a result of your booking such as flight payments, travel insurance, equipment purchases, visas, vaccinations etc.
- Where a major change or cancellation arises from circumstances amounting to force majeure (see below), we will endeavour to refund all sums as yet unpaid by us to our suppliers, however it is your responsibility to claim the remainder of any irrecoverable payments and charges from your travel insurers.
- Liability and Insurance
- We accept no liability for loss, damage, delay, inconvenience, or direct or consequential loss, however caused, unless due to our negligence, in which case our liability is limited to a maximum of the tour cost.
- We will use all reasonable means to ensure that our tours adhere to the agreed schedule but we will not incur any liability whatsoever in the event of any delay due to causes or circumstances beyond our control.
- We shall not be liable for any damages caused by the total or partial failure to carry out your tour if such failure is: attributable to anyone other than a guide working on behalf of Infinite Scotland; unforeseeable or unavoidable and attributed to a third party; a result of unusual or unforeseeable circumstances, reasonably beyond our control; a result of an event which we, even with all due care, could not foresee.
- We shall not be held liable for independent travel or other arrangements made by you before, during or after your tour.
- Any information provided by us on such matters as climate, travel, clothing, special equipment etc. is given in good faith but without any liability to you or responsibility on our part.
- We strongly recommend that you take out a travel insurance policy as soon as you have booked your tour with us.
- A travel insurance policy protects you and your holiday arrangements from the unexpected before and during your tour. It is your responsibility to decide what cover you need, but we recommend your policy should include cover for emergency medical costs, cancellation or curtailment of your tour, personal belongings/baggage and personal liability:
- In the event of emergency rescue and medical care and/or repatriation from a tour due to injury or medical emergency, any evacuation and medical costs will be borne by the client.
- If you need to cancel your tour with us then you may lose some or all of the money you have paid.
- All luggage and personal equipment are, at all times, at your own risk. We will not be responsible whatsoever for any loss, damage to your luggage and/or personal equipment.
- Miscellaneous
- Children:
- We are very happy to welcome your children to Scotland and to enjoy your tour with you. The age(s) of your child (children) must be notified to us in advance so that we can arrange a suitable child seat for the vehicle. This information will also enable us to plan your tour itinerary so that it is suitable for all ages within your group.
- Children remain the responsibility of their parent or guardian at all times.
- Preparedness
- It is your responsibility to ensure that you have read and agreed to all details of your tour itinerary in advance of making your first payment to us. This is to make sure that you get the most out of your tour with us and that we all enjoy our time together! Any subsequent changes to your tour itinerary may be subject to an additional payment.
- It is also your responsibility to ensure that you have clothing and equipment suitable for the activities as set out in your agreed tour itinerary. In particular Scotland has a (sometimes fair) reputation for changeable weather – we have plenty of glorious, sunny days but these can transform quickly to cold, inclement weather without warning. We will endeavour to ensure your enjoyment of our wonderful country regardless of the weather, but part of this relies upon you bringing appropriate clothing, including a waterproof jacket and non-slip shoes with good tread.
- Accommodation
- Unless included as an exceptional “experiential” visit within your tour itinerary, we will not arrange accommodation on your behalf, and this is not included within the price paid for your tour.
- It is your responsibility to book and pay for your own accommodation in line with the agreed tour itinerary. We will provide recommendations and assist you where possible and if requested, but we accept no liability for any accommodation provider on your tour.
- We will not accept payment for any element of your tour with us until you have confirmed to us in writing that you have booked your accommodation for all nights of the planned tour itinerary.
- We will arrange any accommodation for your driver-guide where required. The cost of this will be included in the total price of your tour.
- Complaints
- We work hard to make sure that you enjoy your tour with us. However, sometimes things can go wrong, whether this is within or outside our control. If you are unhappy before or during your tour, please raise your concerns with us at the earliest possible moment. We will endeavour to rectify the situation to the best of our ability and we might even manage to turn a tricky moment into the highlight of your trip.
- It is not reasonable to take no action before or whilst on your tour with us, but then to write a letter or e-mail of complaint after the event. Please remember that we will be unable to help if you only mention the issue on your return home.
